Welcome to Nicturnal. By using this website and placing an order, you agree to these Terms & Conditions, which include and incorporate my Returns & Refund Policy and form part of your contract with Nicturnal. Please take a moment to read them carefully before ordering.

1. General Information

This website is operated by Nicturnal. Throughout the site, “I,” “me,” and “my” refer to Nicturnal.
Nicturnal is the trading name of Nicole Poersch, a sole trader operating in the United Kingdom.
By accessing my site or purchasing from me, you agree to these terms. If you do not agree, please do not use my services.
I reserve the right to update, change, or replace any part of these terms at any time.

2. Products & Orders

My products include astrophotography prints (framed and unframed) and jewellery featuring original astrophotography.
All product descriptions, images, and prices are subject to change without notice.
I reserve the right to refuse service or cancel orders at my discretion. If I cancel an order, I will issue a full refund.

3. Jewellery Box Selection

Where possible, customers may select their preferred Milano ECO jewellery box (matte black leatherette or rose soft-touch) when purchasing a piece. In rare cases, due to low stock, technical issues, or errors, the chosen box may be substituted with an alternative of equal quality. I will always ensure your jewellery is carefully presented and protected.

4. Payment & Pricing

Prices are listed in GBP (£) and may change at any time.
I accept payments via PayPal, credit/debit cards, or agreed bank transfer. Any applicable bank or card charges are your responsibility.
Payments must be completed before an order is processed.
All card payments are subject to authorisation by the card issuer. I am not responsible for delays or non-delivery caused by payment authorisation failure.

5. Intellectual Property & Usage

All images, designs, and content on this website are copyrighted and remain the property of Nicturnal.
Purchasing a print or digital image does not transfer copyright. You may not resell, modify, or distribute my images without permission.
Jewellery designs are exclusive to Nicturnal and may not be copied or reproduced.

6. Jewellery Disclaimer

My jewellery is intended for adult wear only and is not suitable for children due to small parts that may pose a choking hazard.
Some materials used may cause allergic reactions in sensitive individuals. Please check product descriptions for material details before purchasing.
Jewellery is made in a home studio where a dog is present. All pieces are cleaned and polished before dispatch, but a small chance of pet allergens may exist.
Care instructions are available on product pages and in my Jewellery Care & Safety Guide to help you maintain the quality, longevity, and safe use of your pieces. Please follow all guidance carefully to avoid injury.

7. Shipping & Delivery (UK Only)

Nicturnal currently only ships within the United Kingdom. Orders placed outside the UK will be cancelled and refunded.

Jewellery

Each jewellery piece is carefully prepared, packaged, and dispatched directly by me.
As every order is individually made to order, please allow up to 2 weeks for dispatch. Many orders are ready sooner, and I always aim to dispatch them as quickly as possible.
You are responsible for ensuring delivery details are accurate. If incorrect details result in failed delivery, redelivery may be charged to you.
Once an item has been dispatched, delivery times are outside of my control. I cannot be held responsible for lost or delayed packages once marked as delivered.

Astrophotography Prints

Prints are produced and dispatched by my professional print partner.
Dispatch and delivery times are determined by the print partner and may vary depending on the product and delivery method selected.
Print orders may arrive separately from jewellery items if both are purchased in the same order.

8. Distance Selling & Consumer Rights (UK Customers)

Full details of the returns process are set out in my Returns & Refund Policy.
You have the right to cancel your order within 14 days of receiving your item, in accordance with UK consumer law.
To exercise this right, you must notify me in writing within this period.
Once cancellation has been confirmed, items must be returned within 14 days.
Returned items must include all components, be unused, unworn, and in their original condition and packaging (unless faulty or damaged).
Until items are returned and received, they remain your responsibility. I am not responsible for items lost in return transit.
Refunds are issued for the price paid at the time of purchase and will include the standard delivery cost originally charged (if applicable).

Exceptions: Personalised or custom-made jewellery, made-to-order prints, digital downloads, and earrings (for hygiene reasons) are exempt from the 14-day cancellation right under the Consumer Contracts Regulations 2013, unless faulty or not as described.

Return postage costs are the responsibility of the customer unless the item is faulty or incorrect.
If an item is faulty, please contact me first with photographs so I can advise on the next steps.

Nothing in these Terms affects your statutory rights under UK consumer law.

9. Limitation of Liability

I am not liable for any indirect, incidental, or consequential damages resulting from the use of my products.
I am not responsible for lost or stolen packages once they have been marked as delivered by the carrier.
